Announcement of Forthcoming Changes to Sexual Assault Prevention and Response Policy
This MARADMIN announces forthcoming changes to the Marine Corps Sexual Assault Prevention and Response (SAPR) policy based on the National Defense Authorization Act 2021 and updated Department of Defense instructions. The changes affect the entire Marine Corps Total Force and include updates to training requirements, reporting procedures, forensic evidence retention, victim eligibility for restricted reporting, and Case Management Group meeting requirements.

1. Background. This MARADMIN announces the publication of reference (a) which informs the total force of changes to the Sexual Assault Response and Prevention (SAPR) policies. This revision is the result of a collective effort between the Department of Defense and all Services. 2. Reference (b) is federal law that establishes policy for the Department of Defense, assigns responsibilities, and prescribes procedures for the implementation, management, and oversight of SAPR. The policy updates released 10 Nov 21 per reference (a), located at www.sapr.mil/latest-policy-updates, include: 2.a. Outlined responsibilities of the Secretaries of the Military Departments to ensure compliance with each of the policy changes. 2.b. Updated training requirements and prevention efforts for commanders at every level. 2.c. Amended retention period for Sexual Assault Forensic Exam kits from 5 years to 10 years from the date of the seizure of evidence and until after the conclusion of all legal, adverse action, and administrative proceedings unless specifically requested by the victim using a DD Form 2910-3. 2.d. Expanded eligibility for the Catch a Serial Offender program to Unrestricted Reports when the identity of the suspect was not disclosed by the victim or uncovered by law enforcement, to include Military Criminal Investigative Organizations (MCIO). 2.e. Updated sexual assault and retaliation reporting forms, requests for copies of forms, and procedures for the retention of forms including DD 2910, DD 2910-1, and DD 2910-2 plus the establishment of DD 2910-3, "Return of Victim's Personal Property in Restricted Sexual Assault Cases Collected During a Sexual Assault Forensic Examination" per Ref (c). 2.f. Updated requirements for the posting of information regarding a sexual assault and retaliation stemming from a sexual assault. 2.g. Established requirements for Sexual Assault Response Coordinators (SARC) to input all SAPR-Related Inquiries (SRI) into the SRI Defense Sexual Assault Incident Database module within 48 hours (96 hours in a deployed zone). 2.h. Expanded eligibility for victims to file a Restricted Report though still disclosing the sexual assault to whomever they choose; providing they did not personally report the sexual assault incident to law enforcement, to include MCIO, and they did not previously elect to make an Unrestricted Report on the same sexual assault incident. 2.i. Updated requirements for commanders and SARCs executing an expedited transfer for a victim (military and military dependent). 2.j. Revised purpose and requirements of the monthly Case Management Group (CMG) meeting and discussion topics at the quarterly CMG meeting. 3. This MARADMIN is applicable to the Marine Corps Total Force. 4. This MARADMIN is cancelled once incorporated into references (d) and (e). 5. Release authorized by LtGen David A.
