Policy for Managing Reservists Activated in Support of the Global War on Terrorism

This MARADMIN establishes comprehensive policy for managing Reserve Marines activated in support of the Global War on Terrorism, including procedures for activating reservists beyond 16 years of service, managing those in "sanctuary" status (within two years of retirement eligibility), and implementing a seamless transition process from activation to Active Duty Special Work orders after 24 months of activated service. The policy provides flexibility to retain qualified reservists while ensuring compliance with statutory requirements and balancing operational needs against individual impacts.

1.  PURPOSE.  THIS MARADMIN CANCELS MARADMIN 
123/03 AND PROMULGATES POLICY FOR THE ACTIVATION, ASSIGNMENT, AND 
RETENTION OF RESERVISTS IN SUPPORT OF THE GLOBAL WAR ON TERRORISM.  
THIS INCLUDES:
   A.  ACTIVATING/EXTENDING RESERVISTS ON ACTIVE DUTY WHO HAVE 16 
OR MORE YEARS OF ACTIVE SERVICE.
   B.  MANAGING RESERVISTS IN SANCTUARY.
   C.  TRANSITIONING RESERVISTS FROM ACTIVATION TO ADSW ORDERS 
ONCE THEY HAVE BEEN ACTIVATED A TOTAL OF 24 MONTHS (THE SEAMLESS 
TRANSITION (ST) PROCESS).  THIS PARAGRAPH IS APPLICABLE TO ALL 
RESERVISTS, REGARDLESS OF THEIR AMOUNT OF ACCRUED ACTIVE SERVICE.
   D.  PROCESS FOR REQUESTING RETIREMENT FOR RESERVISTS IN 
SANCTUARY.
   E.  MANAGING MEMBERS OF THE IMA. 
2.  BACKGROUND.
   A.  SANCTUARY.  REF A DIRECTS THAT OFFICERS AND ENLISTED 
MEMBERS OF THE RESERVE COMPONENT ON ACTIVE DUTY WITHIN TWO YEARS 
OF RETIREMENT ELIGIBILITY (THE EIGHTEEN-YEAR, ONE-DAY ACTIVE 
SERVICE MARK) NOT BE INVOLUNTARILY RELEASED BEFORE BECOMING 
ELIGIBLE FOR RETIREMENT PAY UNLESS APPROVED BY THE SERVICE 
SECRETARY.  THIS IS KNOWN AS SANCTUARY.
   B.  THE SIXTEEN-YEAR RULE.  REF B LIMITS RESERVISTS FROM 
PERFORMING ADSW BEYOND SIXTEEN YEARS OF ACTIVE SERVICE.  ADSW, 
THROUGH SHORT TOURS OF ACTIVE DUTY, PROVIDES RESERVE PERSONNEL 
TO SUPPORT ACTIVE COMPONENT (AC) EXISTING AND EMERGING, 
SHORT-TERM, PERSONNEL AUGMENTATION REQUIREMENTS.  ADSW IS NOT 
A CAREER PATH.  PER REF C, THIS POLICY WAS EXTENDED TO THE 
ACTIVATION OF RESERVISTS IN SUPPORT OF OPERATION NOBLE 
EAGLE/ENDURING FREEDOM (ONE/OEF) FOR THE SAME REASONS.  HOWEVER,
AN INCREASE IN MOBILIZATION TEMPO CREATED A CORRESPONDING NEED 
TO MAXIMIZE THE USE OF "VOLUNTEER" RESERVISTS AND INCREASE 
FLEXIBILITY TO RETAIN INDIVIDUALS, ON A CASE-BY-CASE BASIS, 
REGARDLESS OF SANCTUARY CONCERNS.  DC, M&RA APPROVED A REVISED
SANCTUARY POLICY IN JUL 02 THAT DELEGATED APPROVAL AUTHORITY TO
COMMARFORRES FOR ACTIVATING SMCR UNIT MEMBERS BEYOND THE 16-YEAR 
MARK.  IN JAN 03, DC, M&RA DELEGATED SIMILAR APPROVAL AUTHORITY 
TO CMC (MP) TO ACTIVATE OR RETAIN IMA/IRR RESERVISTS BEYOND THE 
16-YEAR MARK. 
   C.  THE SEAMLESS TRANSITION (ST) PROCESS.  NORMALLY, THE 
TRANSITION FROM ACTIVATION ORDERS TO ADSW-CO OR EAD ORDERS WOULD
REQUIRE THAT RESERVISTS BE RELEASED FROM ACTIVE DUTY.  THE 
RESULTING BREAK IN SERVICE CAUSES A NUMBER OF NEGATIVE IMPACTS 
ON THE RESERVIST (LOSS OF ACCRUED LEAVE, LOSS/DISRUPTION OF PAY 
AND ENTITLEMENTS, DISENROLLMENT FROM DEERS, RETURN TO HOME OF 
RECORD REQUIREMENTS, ETC).  THE ST PROCESS ELIMINATES THE NEED 
FOR A BREAK IN SERVICE BY MAINTAINING THE "KM" COMP CODE STATUS 
IN MCTFS WHILE A RESERVIST TRANSITIONS FROM ACTIVATION TO 
ADSW-CO ORDERS.
3.  POLICY.  
   A.  ACTIVATION/EXTENSION OF RESERVISTS BEYOND SIXTEEN YEARS
OF ACTIVE SERVICE.  ACTIVATION OF RESERVISTS WITH SIXTEEN OR MORE
YEARS OF ACTIVE SERVICE IS AN ADDITIONAL TOOL TO HELP COMMANDERS 
MEET INCREASED REQUIREMENTS FROM LIMITED MANPOWER POOLS.  HOWEVER,
COMMANDERS ARE DIRECTED TO USE THIS TOOL PRUDENTLY BY ENSURING 
THE SERVICES OF THE RESERVIST ARE ESSENTIAL AND THERE ARE NOT 
SIMILARLY QUALIFIED RESERVISTS AVAILABLE FOR ACTIVATION WHO 
POSSESS LESS THAN YEARS SIXTEEN YEARS OF ACTIVE SERVICE.
       (1) SMCR UNITS.  COMMARFORRES WILL CONTINUE TO HAVE 
APPROVAL AUTHORITY OVER SMCR UNIT MEMBERS.  REF D CONTAINS 
ADDITIONAL GUIDANCE.   
       (2) INDIVIDUALS (IMA/IRR).  COMMANDERS CAN REQUEST THE 
ACTIVATION OR EXTENSION OF IMA/IRR RESERVISTS VIA THE CHAIN OF 
COMMAND TO CMC (MPP-60).  MPP-60 WILL EVALUATE THESE REQUESTS ON A 
CASE-BY-CASE BASIS, BALANCING THE OVERALL OPERATIONAL REQUIREMENTS 
OF THE COMMANDER AGAINST THE IMPACT OF RETAINING THESE RESERVISTS 
UNTIL THEY QUALIFY FOR A REGULAR RETIREMENT.  THE PROCEDURES FOR 
REQUESTING THE ACTIVATION OR EXTENSION OF THESE RESERVISTS, 
PROMULGATED IN REF E, HAVE NOT CHANGED. 
   B.  MANAGING RESERVISTS IN SANCTUARY.  REFERENCE (A) PROHIBITS
THE INVOLUNTARY RELEASE OF A SERVICE MEMBER IN SANCTUARY.  
COMPLIANCE WITH THIS STATUTORY REQUIREMENT IS THE RESPONSIBILITY 
OF CMC (MPP-60).  ONCE A RESERVIST REACHES SANCTUARY, CMC (MPP-60)
WILL MANAGE THIS POPULATION, COORDINATING THE NECESSARY ACTIVE 
DUTY ORDERS TO MEET THE SANCTUARY REQUIREMENTS OF REF A.  THE 
ORDERS PROCESS AND CORRESPONDING RESPONSIBILITIES ARE OUTLINED 
BELOW.  
       (1) TYPE/PRECEDENCE OF ORDERS.  ORDERS (ACTIVATION, 
ADSW-CO OR EAD) USED TO KEEP THE RESERVISTS ON ACTIVE DUTY UNTIL
ELIGIBLE FOR A REGULAR RETIREMENT WILL BE ISSUED IN THE FOLLOWING
PRECEDENCE.
           (A) ALL RESERVISTS WILL INITIALLY RECEIVE ACTIVATION
ORDERS (IAW 10 US CODE SECTION 12302).
           (B) EXTENSION OF CURRENT ACTIVATION ORDERS.  ONCE A 
RESERVIST ENTERS SANCTUARY, CMC (MPP-60) WILL AUTOMATICALLY EXTEND
THE RESERVIST'S CURRENT SET OF ACTIVATION ORDERS OUT TO A TOTAL OF
24 MONTHS OF ACTIVATED SERVICE.    
           (C) ADSW-CONTINGENCY ORDERS (ADSW-CO).  ONCE A 
RESERVIST REACHES THE 24-MONTH LIMIT ON ACTIVATED SERVICE, CMC 
(MPP-60) WILL ISSUE THE RESERVIST ADSW-CO ORDERS (IAW 10 US CODE 
SECTION 12301(D)).  
           (D) EXTENDED ACTIVE DUTY (EAD) ORDERS.  EAD ORDERS 
WILL BE ISSUED BY CMC (MM) ONCE THE GLOBAL WAR ON TERRORISM ENDS AND
CONTINGENCY FUNDS ARE NO LONGER AVAILABLE.
           (E) WHEN A RESERVE OFFICER ENTERS SANCTUARY, CMC 
(MPP-60) MAY, AT ITS DISCRETION, IMMEDIATELY TRANSITION THE OFFICER
FROM ACTIVATION TO ADSW-CO ORDERS, REGARDLESS OF WHETHER THE 
24-MONTH LIMIT HAS BEEN REACHED.
       (2) ASSIGNMENTS.    
           (A) ACTIVATION/ADSW-CO ORDERS.  RESERVISTS WHO HAVE
ENTERED SANCTUARY WILL BE ASSIGNED BY MPP-60 IN COORDINATION WITH
MARFORPAC, MARFORLANT, MARFORRES OR HQMC/MCCDC.  ASSIGNMENTS WILL 
BE BASED UPON THE FOLLOWING PARAMETERS:
               (1) MEMBER'S ABILITY TO FILL THE IA REQUIREMENT.
               (2) MEMBER'S GEOGRAPHIC PREFERENCE
               (3) RELATIVE COST FACTORS BETWEEN PCS AND TAD 
ASSIGNMENT.
               (4) OPERATIONAL REQUIREMENTS MAY DICTATE CHANGES 
IN ASSIGNMENTS.  MEMBERS IN HIGH DEMAND, LOW DENSITY MOS/OCC 
FIELDS MAY BE TRANSFERRED TO A DIFFERENT MARFOR/GFC ISO EMERGING 
OR ROTATIONAL BILLET REQUIREMENTS.
           (B) EAD ORDERS.  CMC (MM) WILL MAKE ALL EAD 
ASSIGNMENTS.  RESERVISTS ISSUED EAD ORDERS ARE AVAILABLE FOR 
WORLDWIDE SERVICE.
       (3) TRANSFER TO IRR.  ONCE RESERVISTS ACCEPT AND ENTER 
SANCTUARY, THEY ARE NO LONGER AUTHORIZED TO DRILL WITH THEIR 
RESPECTIVE SMCR/IMA UNIT.  THEREFORE, THEY WILL BE ADMINISTRATIVELY
TRANSFERRED TO THE IRR (THIS ACTION WILL NOT AFFECT THEIR ACTIVE 
DUTY STATUS).  CMC (MPP-60) WILL CONTACT THE MISSA AND DIRECT THEM
TO MODIFY THE RESERVIST'S RESERVE RUC IN MCTFS TO 88801-88805, 
WHICHEVER APPLIES, THEN RUN TTC 109 001, RESERVE COMP CODE  "K7" 
AND TRAINING CATEGORY PAY GROUP "H".    
           (A) SMCR UNIT RESERVISTS.  ACTIVATED SMCR RESERVISTS 
WHO ACCEPT AND ENTER SANCTUARY WILL BE TRANSFERRED TO THE IRR ONCE
THEIR SMCR UNIT DEACTIVATES OR THEY ARE TRANSFERRED TO AN IA 
BILLET, WHICHEVER OCCURS FIRST.
           (B) IMA RESERVISTS.  ACTIVATED IMA RESERVISTS WHO 
ACCEPT SANCTUARY WILL BE TRANSFERRED TO THE IRR IMMEDIATELY UPON 
ENTERING SANCTUARY.
       (4) DECLINING SANCTUARY.  SHOULD ANY RESERVIST DECLINE 
TO ACCEPT SANCTUARY, HE OR SHE WILL BE RELEASED FROM ACTIVE DUTY 
AT THEIR EAS.  THE GFC WILL NOTIFY CMC (MPP-60) OF THE RESERVIST'S
DECISION ASAP.  RESERVISTS WILL SIGN THE FOLLOWING PAGE 11 ENTRY 
SIGNIFYING THEIR DECISION TO DECLINE SANCTUARY: "I UNDERSTAND THAT
ALTHOUGH I QUALIFY FOR SANCTUARY STATUS COMMENSURATE WITH MY 
HAVING OVER 18 YEARS OF ACTIVE DUTY SERVICE IN THE UNITED STATES 
MARINE CORPS, I AM REQUESTING VOLUNTARY RELEASE FROM MY CURRENT 
SET OF ACTIVE DUTY ORDERS AT MY EAS.  THIS ACTION WILL REMOVE ME 
FROM SANCTUARY STATUS."   
   C. THE ST PROCESS.  WHEN A RESERVIST TRANSITIONS FROM 
ACTIVATION TO ADSW-CO ORDERS, THE FOLLOWING WILL OCCUR:
      (1) OPTIMALLY, PLANNING FOR THE ST PROCESS WILL OCCUR 30-60
DAYS PRIOR TO THE ACTUAL TRANSITION.    
      (2) CMC (MPP-60) SHALL DIRECT THE APPROPRIATE GFC/SMCR UNIT 
TO END THE RESERVIST'S CURRENT SET OF ACTIVATION ORDERS IN THE 
RESERVE ORDERS WRITING SYSTEM (ROWS) ON A SPECIFIED DATE, 
APPROXIMATELY TWO WEEKS PRIOR TO THE RESERVISTS ORIGINAL EAS.  
THIS ACTION IS ONLY DONE IN ROWS, NO MCTFS ENTRIES ARE REQUIRED.
      (3) CONCURRENTLY, CMC (MPP-60) SHALL DIRECT MARINE CORPS 
MOBILIZATION COMMAND (MCMC) TO ISSUE A NEW SET OF ADSW-CO ORDERS 
TO BEGIN IMMEDIATELY UPON THE DATE THE CURRENT SET WILL BE 
TERMINATED IN ROWS.  THE TRANSITION FROM ACTIVATION (12302) TO 
ADSW-CO (12301(D)) ORDERS OCCURS ONLY AFTER A RESERVIST HAS SERVED
24 MONTHS OF ACTIVATED SERVICE. 
   D.  PROCEDURES FOR REQUESTING, APPROVING, AND EFFECTING THE 
REGULAR RETIREMENT OF RESERVISTS IN SANCTUARY.  
       (1) PER REF A, THERE IS NO LEGAL REQUIREMENT TO RETAIN A 
RESERVIST ON ACTIVE DUTY ONCE THEY ARE ELIGIBLE FOR A REGULAR 
RETIREMENT.  RESERVISTS APPROACHING 20 YEARS OF ACTIVE SERVICE 
HAVE THE FOLLOWING OPTIONS:
           (A) REQUEST RETIREMENT IAW REF F.  RESERVISTS FACING 
MANDATORY RETIREMENT MUST SUBMIT A RETIREMENT REQUEST.  THOSE 
RESERVISTS WHO FAIL TO DO SO WILL BE DISCHARGED AT THEIR EAS.
           (B) THE GFC MAY REQUEST A WAIVER TO RETAIN A RESERVIST
ON ACTIVE DUTY ISO VALIDATED REQUIREMENTS BEYOND 20 YEARS OF 
ACTIVE SERVICE IF SNO/SNM HAS NOT REACHED THEIR SERVICE 
LIMITATIONS.  REQUESTS WILL BE SUBMITTED TO CMC (MPP-60) UTILIZING
THE FORMAT IN REF E.  REQUESTS SHOULD BE SUBMITTED AT LEAST SIX 
MONTHS PRIOR TO REACHING THE 20-YEAR SERVICE MARK.  
           (C) THE MEMBER, VIA THE GFC, MAY REQUEST TO REMAIN 
ON ACTIVE DUTY IN A RETIRE/RETAIN STATUS ISO OF VALIDATED 
REQUIREMENTS.  REQUESTS WILL BE SUBMITTED TO CMC (MMSR) UTILIZING
THE FORMAT IN REF E.  REQUESTS MUST BE SUBMITTED AT LEAST SIX 
MONTHS PRIOR TO REACHING THE 20-YEAR SERVICE MARK OR MANDATORY 
RETIREMENT DATE.
           (D) BE VOLUNTARILY RELEASED FROM ACTIVE DUTY, THUS
DECLINING SANCTUARY PER PARA 3B(4) ABOVE, AND REMAIN ON THE 
RESERVE ACTIVE STATUS LIST (RASL), IF SERVICE LIMITATIONS PERMIT,
AND PURSUE A RESERVE RETIREMENT BY JOINING AN SMCR UNIT OR IMA 
DET. 
       (2) RETIREMENT ADMINISTRATION.  FOR THOSE REQUESTS THAT
ARE APPROVED, CMC (MMSR-2) SHALL USE SPD CODE "RBD8", PER 
PARAGRAPH 100501 OF THE MCTFSPRIM, WHEN EFFECTING THE RETIREMENT
OF A SANCTUARY RESERVIST.   
       (3) PROMOTIONS.  RESERVISTS WHO ARE SELECTED/PROMOTED 
WHILE 
IN SANCTUARY WILL NOT BE RETAINED ON ACTIVE DUTY ONCE THEY ARE
RETIREMENT ELIGIBLE SOLELY FOR THE PURPOSE OF FULFILLING THE
TIME-IN-GRADE REQUIREMENTS MANDATED BY REF F.
   E.  MANAGING MEMBERS OF THE IMA.  THE PROVISIONS OF PARAGRAPH
5G OF REF G REMAIN IN EFFECT WITH THE FOLLOWING EXCEPTIONS:
       (1) EFFECTIVE IMMEDIATELY, ACTIVE COMPONENT OPSPONSORS 
MAY REQUEST THE TRANSFER TO THE IRR OF IMA MARINES WHO HAVE 
EXCEEDED THEIR THREE-YEAR TOUR LIMIT AS A RESULT OF ACTIVATION AND
WHO ARE NOT SERVING IN THEIR RESPECTIVE COMMAND BILLET.  THIS 
POLICY IS ONLY APPLICABLE IN CASES WHERE THE IMA MARINE WAS 
ACTIVATED OR VOLUNTEERED IN SUPPORT OF A UNIT OTHER THAN THE 
OPSPONSOR.  THIS POLICY IS INTENDED TO GIVE OPSPONSORS THE 
FLEXIBILITY TO OPEN UP THEIR IMA BILLETS TO RESERVISTS WHO CAN 
DRILL WITH THE OPSPONSOR.  
       (2) REQUESTS WILL BE SUBMITTED IN STANDARD NAVAL LETTER 
FORMAT TO CMC (RAP).  REQUESTS WILL INCLUDE THE RESERVIST'S NAME, 
RANK, SSN,  IMA PLT CODE, AND JUSTIFICATION FOR THE REQUESTED 
TRANSFER.
