Unit Punishment Book Policy Update

This MARADMIN updates Marine Corps policy on the Unit Punishment Book (NAVMC 10132) used to document nonjudicial punishment for both officers and enlisted Marines. The revised form now collects anonymous demographic data to comply with federal reporting requirements, and detailed completion instructions previously found in MCO 5800.16 are rescinded in favor of instructions contained within the form itself. The policy is effective immediately and applies to the entire Marine Corps Total Force.

1.  Purpose.  To update service guidance regarding the completion of NAVMC 10132 Unit Punishment Book entries for officers and enlisted Marines.
2.  Background.  Reference (a) requires the collection and reporting of statistics pertaining to offenses in the armed forces. NAVMC 10132 has been revised to comply with reference (a) by collecting anonymous demographics, and may be found at https:(slash)(slash)forms.documentservices.dla.mil/order/view.cfm?reqNsn=NONSN00001279.  Consequently, this MARADMIN updates instructions for completing NAVMC 10132 found in reference (e).
3.  Policy.  Effective immediately, the detailed instructions for completion of NAVMC 10132 contained in volume 14 of reference (e) are rescinded. Refer instead to the instructions section of the NAVMC 10132 form.  The NAVMC 10132 form shall also be used to document the processing of officer nonjudicial punishment, in addition to the documents required by volume 15 of reference (e).
4.  For the electronic NAVMC 10132 to work properly, it must be completed and signed in accordance with the instructions on the third page of the NAVMC 10132 form.  Signature fields lock completed sections of the form, and signing item 16 locks the entire form.  When accessing the form via the above link, users must download and save the NAVMC 10132 form to a computer prior to entering any information.  Opening the form using a web browser will limit functionality and result in errors.
5.  The following changes to MCO 5800.16, Legal Support and Administration Manual, Volume 14 (Enlisted Nonjudicial Punishment Matters and Preparation of the Unit Punishment Book), are effective immediately and will be incorporated into the next revision thereof.
5.a.  Paragraph 011103 is modified by striking "will be prepared electronically, typewritten, or handwritten (legibly) in black or blue-black ink" and inserting "should be prepared electronically, but may be prepared by typewriter or legibly by hand using black or blue-black ink."
5.b.  Paragraph 011104 is modified by striking "corrections will be made" and inserting "corrections to manually prepared forms will be made."  Paragraph 011104 is further modified by striking the entirety of the last sentence.
5.c.  Paragraph 011105 is modified to read "For detailed preparation instructions, refer to the instructions section of the NAVMC 10132 Unit Punishment Book form."  Paragraphs 011105.A through 011105.R are deleted in their entirety.
6.  The following changes to MCO 5800.16, Legal Support and Administration Manual, Volume 15 (Officer Misconduct and Substandard Performance of Duty), are effective immediately and will be incorporated into the next revision thereof.
6.a.  Paragraph 010502.B.1 is modified to read "The Unit Punishment Book (UPB) will be used in officer NJP cases.  The UPB will be completed in addition to the notifications provided in Figures 15-1 or 15-2, as appropriate; the notice provided in Figure 15-3; and the report provided in Figure 15-5.
6.b.  Paragraph 010502.B.5 is deleted and replaced with "In order to comply with 10 U.S.C., section 615, commanding generals who impose NJP on an officer will provide a copy of the UPB entry to the officer along with an opportunity to submit matters in response.  The UPB entry, acknowledgement of the opportunity to submit matters, and any response must be provided to the local personnel administration center for inclusion into the officer's OMPF.  Those documents will also be included as enclosures to the Report of NJP."
6.c.  Paragraph 010605 is modified by appending at the end a new subparagraph "D.  A copy of the NAVMC 10132 Unit Punishment Book, Acknowledgement of UPB Entry, and any matters in response submitted by the officer."
6.d.  Figure 15-5, Report of Nonjudicial Punishment, is modified to include the following enclosures: Unit Punishment Book, Acknowledgement of UPB Entry, and matters in response to UPB Entry (if any).
7.  This MARADMIN will take effect upon publication and remain in force until incorporated into reference (e) or cancelled by a future MARADMIN.  Judge Advocate Division will promulgate a practice directive further detailing requirements for officer NJPs.
8.  This MARADMIN is applicable to the Marine Corps Total Force.
